Jinggoy Estrada charges involving plunder and graft are now being challenged before the Sandiganbayan after the senator’s legal team filed “Omnibus Motions Ad Cautelam” before the court’s Second and Fifth Divisions.
Jinggoy Estrada Charges Face Legal Challenge
The motions are connected to the plunder and graft cases filed by the Office of the Ombudsman over alleged irregularities involving government flood-control projects. Estrada is accused of receiving kickbacks from infrastructure-related allocations, allegations he has denied.
In legal terms, an omnibus motion is a filing that raises several requests or arguments in one document. The phrase “ad cautelam” means “as a precaution.” In this case, the filing allows Estrada’s camp to question the charges while preserving available legal remedies.
According to reports from GMA News, the Office of the Ombudsman filed plunder and graft cases against Estrada in connection with alleged flood-control project kickbacks.
Why the Motions Were Filed
Estrada’s camp is expected to challenge the cases on procedural grounds. His side has raised concerns over alleged irregularities in the filing of the charges and has claimed that evidence favorable to the senator was not properly considered.
The Ombudsman, however, has maintained that the charges are based on case records involving alleged budgetary insertions and project allocations connected to flood-control projects under the Department of Public Works and Highways.

Sandiganbayan Divisions Handling the Cases
The cases are being handled by different Sandiganbayan divisions. The Fifth Division was assigned to the plunder case and one graft case, while the Second Division is handling another graft case.
This explains why Estrada’s legal team filed motions before both divisions. The move signals the start of his formal legal challenge against the new cases.
A report from Inquirer.net also noted the raffle of Estrada’s fresh graft and plunder cases before the Sandiganbayan.
What Happens Next
The Sandiganbayan will now have to act on the motions filed by Estrada’s camp. If the court finds merit in the arguments, it may affect how the cases proceed. If the motions are denied, the cases may continue moving forward.
The graft charges have already led to an arrest warrant and a hold departure order from the Sandiganbayan’s Second Division. Estrada later posted bail in connection with the graft case.
The plunder charge carries heavier consequences, as plunder is generally non-bailable when the evidence of guilt is strong.
For now, Estrada maintains his innocence while prosecutors are expected to pursue the cases filed by the Ombudsman.
The Jinggoy Estrada charges remain a closely watched legal and political issue, especially as the case involves alleged kickbacks from public infrastructure funds.
